1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between Pass Tracker LLC ("we," "us") and the coach, athletic program, or club that creates an account or organization ("you," an "Organization") to use Pass Tracker (the "Service"). By creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

If you are creating an account on behalf of a school, club, or other organization, you represent that you have the authority to bind that organization to these Terms.

2. The service

Pass Tracker is a web application for tracking volleyball serve-receive and pass performance: rosters, practice/match sessions, pass ratings, and related statistics. It is a tool for coaches and administrators ("Users"); the athletes whose performance is tracked ("Players") do not create their own accounts and do not interact with the Service directly under normal use.

Your Organization retains ownership of the roster, session, and pass data you enter into the Service ("your content"). We don't claim ownership of it, and we don't use it to train machine learning models or sell it, consistent with our Privacy Policy.

You grant us a limited license to host, store, and process your content solely to provide the Service to you (for example, displaying your roster back to your Users, or including it in an automated backup).

An Organization admin can export all of that Organization's data at any time, and can permanently delete the Organization and its data from Settings.

6. Beta status

Pass Tracker is currently offered as a beta. Features may change, and the Service may have bugs, downtime, or data issues that a fully released product would not. We take reasonable steps to back up data (see the Privacy Policy), but you should not treat the Service as your only copy of important records during the beta period -- export your data periodically from Settings.

7. Our intellectual property

The Service's software, design, and branding (excluding your content) belong to us or our licensors. These Terms don't grant you any rights to our trademarks, logos, or underlying code beyond what's needed to use the Service as intended.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost, though we take reasonable steps (backups, security headers, tenant isolation) to reduce that risk.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Governing law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved in a court of competent jurisdiction in the United States.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify Organization admins by email or an in-app notice before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
